A building administrator may temporarily suspend a student out of school for a period up to ten (10) consecutive school days. A temporary suspension is a Level II consequence under the Student Code of Conduct.
The notice of suspension shall be documented on a Behavior Tracker Form with a copy sent to the parent and a copy kept at the building level.
When students are temporarily suspended, the following procedures shall be followed:
- Prior to suspension, the building administrator will communicate with the student and parent the reason for the suspension, and allow the student the opportunity to respond.
- The student may be removed from school immediately when his/her presence constitutes a danger to persons or property, or threatens to disrupt the school environment. In such a case, any conference with the student and the student’s parent/guardian should take place as soon as practical.
- Procedures for appealing the imposition of a Level II consequence are set forth in the Student Code of Conduct.
- A determination will be made by the building administrators to whether an Intermediate Hearing will be held for recommended Level III disciplinary consequences, and if so, will notify the Superintendent or his/her designee.
- The notice and hearing process for an intermediate hearing should be initiated as soon as possible following a recommendation for Level III disciplinary consequences.
- An Intermediate Hearing Notice will delineate the student’s due process rights.
- Student and parent(s) will be informed of their rights regarding an appeal from an Intermediate Hearing decision.
When a long-term out-of-school suspension is recommended, the procedures set forth in Board Policy 502.3 shall apply.
Procedures Involving Suspensions for Student Assaults against School Employees
- A student who commits an assault against a school employee in a school building, on school grounds, or at a school-sponsored function shall be suspended for a time to be determined by the building administrator. Notice of the suspension shall be immediately sent to the President of the Board. By special meeting or at the next regularly scheduled board meeting, the Board shall review the suspension and decide whether to hold a disciplinary hearing to determine whether or not to order further sanctions against the student, which may include expelling the student. In making its decision, the Board shall consider the best interests of the District, which shall include what is best to protect and ensure the safety of the school employees and students from the student committing the assault.
- A student shall not be suspended pursuant to this policy if the suspension would violate the federal Individuals with Disabilities Education Act.
